Whose responsibility is it?
According to the updated New York City Department of Buildings’ Elevator Regulations that took effect on January 1, 2009:

“Inspections and tests must be performed by an Approved Elevator Inspection Agency and witnessed by another Approved Elevator Inspection Agency not affiliated with the one performing the test.”

And, it is now the responsibility of the building owner or property manager to procure its Third-Party Witnessing Agency. Leaving it up to the elevator maintenance company to hire a third-party violates the 2009 Elevator Regulations.
